If an acceptable settlement offer is not negotiated in your case, we will take your matter to trial and make sure that your side is heard. Before you decide to go to trial, we will more often than not remind you that the general rule of law in Virginia is that unless attorney's fees are awarded by statute or contract, each side will have to bear their own attorney's fees upfront. The reason this rule of law is generally followed in most cases is because the courts generally do not want to be tied up with frivolous lawsuits. They want each party to bear the cost of litigation in an endeavor to make each party think really hard before filing suit. Generally, a simple General District Court lawsuit will cost each party between $2000 to $2500. This is the retainer that has to be paid upfront before the lawyer will even take the case if the case is going to be tried. In Circuit Court, the costs of litigation could easily reach $10,000 or more. Again, this is a retainer that will have to be paid upfront. Even in the event attorney's fees are authorized by statute or contract, these fees may only be awarded in part by the Court. Unfortunately, this will not necessarily cover all of the attorney's fees accrued in the case. Most experienced civil litigation lawyers will not take a case on a contingency fee. It is for this very reason, that the civil litigation lawyers of SRIS, P.C. will caution a client about going to trial.

We understand our civil litigation law clients do not want to spend any more time and resources on a civil litigation lawsuit than what is absolutely necessary. If you decide to settle your civil litigation case out of court, it may prove to be the more cost-effective and faster way to proceed than going to trial. Most of our clients understand that it is a lot more inexpensive to pay an attorney between $300 to $1000 to try and resolve the matter without having to go through the expense of a trial and run the risk of having an unfavorable outcome.
