A person shall be guilty of reckless driving in Virginia, who drives a motor vehicle on the highways in the Commonwealth of Virginia (i) at a speed of twenty miles per hour or more in excess of the applicable maximum speed limit or (ii) in excess of eighty miles per hour regardless of the applicable maximum speed limit.

VA Code Section 46.2-862 is the reckless driving statute that prohibits driving at reckless speeds. Virginia Code Section 46.2-862 is class 1 misdemeanor in Virginia. The maximum penalty for a conviction of VA Code Section 46.2-862 is 12 months in jail, $2500 fine, 6 months loss of license in Virginia and six points on your Virginia driving record.
